Deficiency rule and law varies by state. I have zero knowledge of Illinois law, but even if you were in Arizona like I am, I would strongly advise you to talk to a local real estate attorney. Real estate agents have to be very careful to not give legal advice. I wish I could be more help, but you really need to consult with an attorney. </description>

What is the new law under hamp or hope that applies to short sales?  If someone did a short sale in 08 and signed a deficiency note, but subsequently lost their job and was unable to pay the debt, what is the best course of action to take according to new law.  if the bank is threatening a judgement against the short seller what is the short sellers option to resolve the issue especially since they have no job ? How long does a real estate deficiency judgement last?  Is there a difference if the deficiency is on the first or second mortgage (both first and second  as part of the original loan packaging by the bank.) Deficiency is in illinois. </description>
