Lori – I can't really address your problem specifically, but my first question would be was a title search requested and title insurance issued on the transaction? If so, the first contact should be with the company that issued the policy. These are the sorts of problems that title insurance is designed to prevent and ultimately cover…

Curious, out here in Los Angeles have a client who was partners on a piece of property, most likely follows same rule as Arizona. He payed partner off and had paperwork drawn up and closed escrow with only himself as the owner. Turns out there was a third partner he was unaware of, that is still on city records as an official owner also on the property. The original partner had added him. The existing owner wants this third owner off the property of course, and he's not sure how to do this. How could escrow not catch this?

Ecrows are not used as commonly in Spanish Property sales . However, they can be useful especially in off plan purchases. The market here is difficult and very few off plan sales are being made. The vast majority of the activity we are seeing is in the resale market. Even here though an escrow is to be recommended.
